How to Calculate a Medical Malpractice Settlement

If your gross settlement is $100,000 and you are 20% at fault, you will only receive $80,000.

4. Attorney Fees and Medical Liens

Your "Gross Settlement" is rarely what ends up in your pocket. Two major deductions occur before you receive your check:

  • Contingency Fees: Medical malpractice attorneys usually work on a contingency basis, meaning they take a percentage of the settlement (typically 33.3% to 40%). They only get paid if you win.
